Post-publicity rights and holograms

Great artists such as Michael Jackson and Frank Jaffa are reviving through holograms. In the case of Whitney Houston, a holographic tour is planned. From the perspective of fans, opinions can be divided on the resurrection of the hologram. However, it is not known whether those who became holograms really wanted to resurrect through this technology.

In the United States, there is something called The Right of Publicity. It refers to the right to allow celebrities to use their name or portrait rights for publicity. The portrait rights of celebrities will keep the face on the lid of the lunch box and the hologram resurrected, so you will be able to release official products with confidence. It is also admitted that about half of the states in the U.S. are post-publicity rights. This is to yield to someone the commercial use of their name or popularity after their death. It means that you can leave your reputation as a fortune to someone.

In states that recognize post-publicity rights, it depends on how commercially using images such as celebrity’s post-mortem holograms or who inherited this right as a legacy. However, in states that do not recognize the right to publicity after death, when a celebrity dies, the image is almost assigned to the public domain.

Whitney Houston has post-publicity rights in an office run by former manager and sister-in-law Pat Houston. What Houston does after the death depends on how it uses its publicity rights.

Anyway, it could be a good thing for fans to revive a celebrity who died through a technology called hologram. However, for the rights holder, overcoming death can be difficult and time consuming. First, the opinion of the right holder should be the top priority. The economic perspective and the way of thinking about the deceased from the perspective of the rights holder may be different.

Also, the use of post-publicity rights is limited to commercial use. It means that even if there is sadness of losing someone, the rights cannot be exercised if they are revived as a hologram in a non-commercial form. Related information can be found here .
