Nintendo sues for permanent ban on pirated rom sites

In June, Nintendo filed a new lawsuit demanding a permanent ban on the site, claiming that it won a lawsuit against an illegal ROM data distribution site, but neglected to pay only $50 a month for the first time as compensation.

Originally, the lawsuit was brought by Nintendo’s US branch to RomUniverse, a site that distributes game roms for the Nintendo 3DS and Nintendo Switch. Operator Matthew Storman lost and was awarded $2.115,000 in damages.

Therefore, ROM Universe was temporarily closed, but the judge in charge of the lawsuit decided not to issue a permanent injunction to permanently close it. However, Nintendo was not satisfied with the ROM Universe as a threat and demanded more drastic measures.

In the first lawsuit, Stoman claimed that he was unemployed, so the $2.1 million in damages would be paid in installments of $50 per month for the next 3,500 years. However, when even the first payment was neglected, Nintendo filed a lawsuit again demanding a permanent injunction.

In the new lawsuit, Nintendo’s failure to pay even the small $50 per month the defendants proposed and agreed to shows that Nintendo lacks adequate remedies under the law for defendants’ past or future infringements and the need for a permanent injunctive relief. insists on a strong demand. In other words, Stoman was outraged that he might ignore the past lawsuit with Nintendo and continue to run the ROM Universe.

This lawsuit is also being applied to new game consoles such as 3DS and Switch, but recently, Nintendo is actively distributing old game collections, HD remasters, and retro games on Nintendo Switch Online. The crackdown or lawsuit against illegal ROM sites that infringe on these past assets may become stronger. Related information can be found here.
